These Terms of Service, together with our Refund Policy, Returns & Right of Withdrawal information, Shipping Policy, Privacy Policy, Cookie Policy, and any other policies or notices posted on our website, govern your access to and use of Laiya Home, including laiyahome.com, our online store, customer account features, checkout, products, content, and related services.

By accessing our website, creating an account, placing an order, submitting information, or using our services, you agree to these Terms. If you do not agree, you must not use our website or services.

Nothing in these Terms limits any mandatory consumer rights, statutory guarantees, legal warranties, or other rights that cannot be excluded under applicable law.

1. About Laiya Home

Laiya Home is an online furniture, lighting, and home objects store offering curated natural, handmade, artisanal, and design-led products for homes, villas, boutique hospitality, wellness spaces, and commercial interiors.

In these Terms, “Laiya Home,” “we,” “us,” and “our” refer to Laiya Home and its owners, operators, affiliates, service providers, and authorized representatives, where applicable.

1. Eligibility and Use of the Website

You may use our website only if you are at least the age of majority in your jurisdiction or have legal authority to enter into these Terms.

By using our website or placing an order, you confirm that:

You have the legal capacity to enter into a contract;
The information you provide is accurate, current, and complete;
You will use the website and services only for lawful purposes;
You will not misuse the website, checkout, customer accounts, promotions, or content;
If you place an order for a business, trade, hospitality, interior design, procurement, restaurant, villa, hotel, or other commercial purpose, you have authority to bind that business or organization.

1. Consumer and Commercial Customers

Some rights and obligations differ depending on whether you are purchasing as a consumer or for business or commercial purposes.

A “consumer” is an individual purchasing goods mainly for personal, household, or non-commercial use.

A “commercial customer” includes businesses, trade customers, interior designers, hospitality buyers, procurement teams, restaurants, villas, hotels, wellness spaces, offices, rental operators, staging companies, retailers, resellers, and other professional buyers purchasing for business or commercial purposes.

Business, trade, hospitality, interior design, procurement, restaurant, villa, hotel, or other professional orders placed for business or commercial purposes may not qualify for consumer right of withdrawal protections. Commercial-use orders are subject to the commercial order terms in these Terms and in our Refund Policy.

1. Customer Accounts

You may need an account to access certain features, including order history, return requests, cancellation requests, or customer account functions.

You agree to provide accurate account information and to keep your login details secure. You are responsible for activity under your account unless the activity results from our failure to use reasonable security measures.

We may suspend or restrict account access where we reasonably believe there is fraud, misuse, unauthorized access, security risk, payment issue, or violation of these Terms.

1. Communications, Marketing and Customer Preferences

Transactional communications relating to orders, accounts, delivery, returns, cancellations, customer service, security, product updates, legal notices, and policy updates may be sent as necessary to provide our services or comply with legal obligations.

Marketing emails, newsletters, promotional messages, abandoned-cart messages, surveys, product recommendations, personalized offers, and similar commercial communications may be sent where we have a lawful basis to do so, including consent where required by applicable law.

You may unsubscribe from marketing communications at any time using the unsubscribe link in the message or by contacting support@laiyahome.com. Unsubscribing from marketing communications will not affect transactional, service-related, legal, or security communications.

Where permitted by law, we may use your order history, browsing behaviour, cart activity, preferences, product interests, customer segment, and engagement with our website or communications to personalize recommendations, offers, advertisements, website content, and marketing messages.

1. Product Information and Natural Variations

We make reasonable efforts to display product descriptions, photographs, dimensions, materials, colours, finishes, availability, pricing, and specifications accurately.

Many Laiya Home products are handmade, natural, artisanal, or made with organic materials such as teak, mango wood, rattan, seagrass, bamboo, stone, ceramic, linen, and woven fibres. Natural variations in colour, grain, texture, weave, tone, shape, dimensions, finish, and surface character may occur.

These variations are part of the character of natural and handmade products and do not, by themselves, constitute a defect.

Product photographs may appear differently depending on screen settings, lighting, photography, production batches, or natural material variation. Measurements may vary slightly due to handmade production or natural materials.

You are responsible for reviewing product dimensions, materials, care instructions, suitability, installation requirements, delivery requirements, and access limitations before placing an order.

1. Product Suitability, Care, and Installation

You are responsible for ensuring that products are suitable for your intended use, interior environment, outdoor exposure, climate, moisture level, traffic level, commercial setting, and installation location.

Furniture, lighting, and decor should be used only as intended and in accordance with any care instructions provided.

Lighting and electrical products must be installed by a qualified professional where required. Laiya Home is not responsible for improper installation, misuse, modification, failure to follow instructions, unsuitable placement, exposure to unsuitable conditions, or damage caused after delivery, except where required by applicable law.

Outdoor suitability varies by product. Unless a product is expressly described as suitable for outdoor use, it should be treated as indoor-only.

1. Orders

When you place an order, you are making an offer to purchase the selected products. An order is accepted only when we confirm acceptance or dispatch the product, depending on the circumstances.

We may refuse, cancel, or limit an order where permitted by law, including where:

A product is unavailable or discontinued;
There is a pricing, inventory, description, or listing error;
Payment is declined or flagged;
Fraud or misuse is suspected;
Delivery is unavailable or impractical;
The order appears to be placed for resale or unauthorized commercial activity;
The order cannot be fulfilled by our supplier, warehouse, carrier, or logistics partner.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item.

1. Pricing, Taxes, Duties, and Payment

Prices are shown in the currency displayed at checkout and may exclude taxes, duties, shipping, delivery surcharges, customs charges, carrier fees, remote-area fees, pallet charges, or other charges unless stated otherwise.

Final charges are shown at checkout before payment, subject to applicable law.

Prices, promotions, discounts, availability, and shipping rates may change without notice, except for confirmed orders where applicable law requires otherwise.

You authorize us and our payment processors to charge your selected payment method for the total amount of your order. Payments are processed through third-party payment providers, including Shopify-supported payment services. We do not store full payment card details.

1. Promotions, Discounts, and Gift Cards

Promotions, discount codes, sale pricing, and special offers are subject to any stated conditions, expiry dates, minimum order values, exclusions, and product limitations.

We may modify, suspend, or cancel promotions where permitted by law, including in cases of error, fraud, misuse, or technical issue.

Discounts generally cannot be combined unless expressly stated.

Gift cards, where offered, are subject to additional terms and are generally non-returnable except where required by law.

1. Shipping, Delivery, Risk, and Access

Delivery dates and timeframes are estimates unless expressly confirmed otherwise in writing.

Laiya Home is not responsible for delays caused by carriers, suppliers, customs, weather, strikes, labour disruptions, force majeure events, incorrect addresses, failed delivery attempts, access restrictions, customer unavailability, remote-area delivery issues, or other circumstances outside our reasonable control.

For consumer orders, risk of loss or damage passes to you when you, or a person nominated by you other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.

For business, trade, hospitality, interior design, procurement, restaurant, villa, hotel, or other commercial-use orders, risk may pass earlier where permitted by law, including when goods are handed to the carrier, logistics provider, project representative, receiving agent, or delivery location specified by the customer.

You are responsible for ensuring the delivery address is accurate and accessible. This includes checking access for large furniture, pallet shipments, elevators, stairways, narrow entrances, parking, loading zones, building restrictions, reception hours, delivery appointments, and any required delivery permissions.

Additional costs caused by incorrect information, failed delivery, refused delivery, redelivery, storage, special handling, pallet handling, access restrictions, or customer unavailability may be charged to you where permitted by law.

1. Inspection on Delivery

Please inspect your order as soon as possible after delivery.

If an item arrives damaged, defective, incorrect, or incomplete, contact us promptly at support@laiyahome.com with your order number, clear photographs of the item, clear photographs of the packaging, and a short description of the issue.

Prompt notice helps us resolve supplier and carrier claims efficiently. This request does not limit any statutory consumer rights you may have.

1. Returns, Refunds, Cancellations, and Withdrawal Rights

Returns, cancellations, refunds, exchanges, damaged items, and EU withdrawal rights are governed by our Refund Policy and Returns & Right of Withdrawal information, which form part of these Terms.

Nothing in these Terms limits any mandatory consumer rights that apply to you under applicable law.

For EU consumers, eligible online purchases may be subject to the legal right of withdrawal, legal guarantees for faulty or non-conforming goods, and other mandatory protections.

For change-of-mind returns and EU right of withdrawal returns, the customer is responsible for the direct cost of return shipping where permitted by law and where disclosed before purchase.

Laiya Home may reduce a refund to reflect diminished value if returned goods have been handled beyond what is necessary to establish their nature, characteristics, and functioning, where permitted by law.

Refunds are issued in accordance with our Refund Policy and applicable law.

1. Commercial, Trade, Hospitality, and B2B Orders

At Laiya Home, we value our trade, hospitality, and professional clients and will aim to work in good faith if an issue arises. Commercial-use orders are handled differently from consumer household purchases, but our goal is to provide a fair, practical, and professional resolution wherever possible.

Orders placed by businesses, trade customers, interior designers, hospitality buyers, procurement teams, restaurants, villas, hotels, wellness spaces, offices, rental operators, staging companies, retailers, resellers, or other professional customers for business or commercial purposes may not qualify for consumer right of withdrawal protections.

For business, trade, hospitality, or other B2B orders placed for commercial purposes, all sales are final unless the item is defective, incorrect, damaged on arrival, returnable under applicable law, or unless Laiya Home agrees to the return in writing.

Change-of-mind returns, free returns, and cancellations after fulfilment are not offered for B2B or commercial-use orders unless agreed by Laiya Home in writing.

This does not affect any mandatory rights that may apply if an item is defective, incorrect, damaged, or not as described.

1. Custom, Bespoke, Special Order, and Made-to-Specification Items

Custom, bespoke, made-to-measure, personalized, specially configured, special order, sourced-to-order, or made-to-specification products may be non-cancellable and non-returnable where permitted by law.

For consumer orders, this applies only where the product falls within a lawful exception to cancellation or withdrawal rights.

For commercial-use orders, custom, sourced, project-based, or special order items are final sale unless defective, incorrect, damaged on arrival, returnable under applicable law, or agreed otherwise by Laiya Home in writing.

1. User Content, Reviews, Project Images and Submissions

If you submit, upload, tag, send, publish, or otherwise provide reviews, photographs, videos, comments, testimonials, project images, styling images, room images, feedback, ideas, designs, suggestions, social media content, or other materials relating to Laiya Home, our products, or your use of our products, you grant Laiya Home a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable licence to use, reproduce, display, publish, distribute, edit, crop, adapt, translate, create derivative works from, promote, advertise, and otherwise exploit that content in connection with our website, product pages, email marketing, social media, advertising, catalogues, lookbooks, commercial materials, analytics, and business operations, to the maximum extent permitted by law.

This licence allows us to use the content in any media or channel, whether now known or developed in the future, including paid and organic marketing, without further compensation to you, unless prohibited by applicable law.

You confirm that you own or have all rights necessary to provide the content and grant this licence, and that the content does not infringe intellectual property rights, privacy rights, publicity rights, contractual rights, or any other third-party rights.

You agree not to submit content that is unlawful, misleading, defamatory, abusive, obscene, discriminatory, infringing, invasive of privacy, or otherwise inappropriate.

We may edit, remove, decline, or stop using user content at our discretion. Where applicable law gives you the right to withdraw consent or request removal of personal data contained in user content, you may contact support@laiyahome.com. We will respond in accordance with applicable law, but removal may not affect uses already made where continued use is lawful.

1. Intellectual Property

The website, brand name, product copy, images, graphics, designs, layout, logos, trademarks, trade dress, videos, text, product descriptions, collections, and other content are owned by or licensed to Laiya Home and are protected by intellectual property laws.

You may use the website for personal shopping and lawful browsing only.

You may not copy, scrape, reproduce, distribute, modify, create derivative works from, commercially exploit, use for training datasets, use for competing businesses, or otherwise misuse any Laiya Home content without our written permission.

1. Prohibited Conduct

You must not:

Use the website or services for unlawful, fraudulent, harmful, or abusive purposes;
Use stolen payment information or engage in chargeback abuse;
Misrepresent your identity or authority;
Interfere with website security or operation;
Use bots, scrapers, crawlers, automated tools, or data extraction methods without permission;

Attempt unauthorized access;
Copy or misuse our product content, images, brand, or intellectual property;

To the maximum extent permitted by applicable law, Laiya Home may collect, access, use, store, analyze, combine, disclose, transfer, and otherwise process information relating to customers, visitors, accounts, orders, browsing activity, communications, preferences, device information, transaction history, product interests, cart activity, returns, customer service interactions, reviews, user content, and related website activity for legitimate business, operational, legal, security, marketing, analytics, and service-improvement purposes.

Process, fulfil, manage, deliver, cancel, refund, or support orders;
Operate customer accounts and website features;
Provide customer service and respond to inquiries;
Manage returns, cancellations, warranty issues, disputes, fraud prevention, chargebacks, and security;

Where permitted by law, Laiya Home may use aggregated, anonymized, de-identified, or non-identifying data for any lawful business purpose, including analytics, benchmarking, product development, merchandising strategy, advertising strategy, market research, operational improvement, and business reporting. This type of information does not identify you personally.

We may share information with service providers, platforms, processors, affiliates, professional advisers, payment providers, fraud-prevention providers, shipping and logistics providers, marketing platforms, analytics providers, advertising platforms, technology vendors, customer support tools, government authorities, regulators, law enforcement, and other parties where permitted or required by law.

We may use cookies, pixels, tags, analytics tools, advertising technologies, customer privacy APIs, and similar technologies to understand website activity, measure advertising performance, personalize content, improve the website, and support marketing. Where consent is required for cookies, tracking, advertising, or similar technologies, we will seek consent through available website tools or customer privacy settings.

We may use third-party tools, automation, analytics systems, and artificial intelligence-supported services to help operate the business, improve customer service, analyze trends, generate insights, detect fraud, segment customers, personalize recommendations, improve marketing, and optimize the website. We retain personal information for as long as reasonably necessary for the purposes described above, including to provide services, maintain records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and operate our business, unless a longer or shorter period is required by law.

Except as required by law, Laiya Home does not guarantee that products will be suitable for every individual purpose, interior environment, commercial use, outdoor exposure, climate, installation condition, or customer expectation.

Natural, handmade, artisanal, and organic-material products may include variations in colour, grain, weave, texture, tone, size, and finish. Such variations are part of the character of natural and handmade goods and do not, by themselves, constitute defects.

1. Limitation of Liability

For consumers, this section applies only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited.

To the maximum extent permitted by law, Laiya Home is not liable for indirect, incidental, special, consequential, punitive, or economic losses, including loss of profits, loss of revenue, loss of business opportunity, loss of data, reputational harm, business interruption, project delay, substitute procurement costs, or loss of expected savings.

For business, trade, hospitality, interior design, procurement, restaurant, villa, hotel, or other commercial-use customers, Laiya Home’s aggregate liability is limited to the amount paid for the relevant order giving rise to the claim, unless a different limit is required by law.

This limitation applies whether the claim is based in contract, tort, negligence, strict liability, statute, or any other legal theory.

1. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Laiya Home from claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from your misuse of the website, violation of these Terms, violation of law, infringement of third-party rights, fraud, negligent conduct, commercial use of products, or unauthorized use of our content.

For consumers, this section applies only to the extent permitted by applicable law.

1. Dispute Resolution

For consumers, nothing in this section limits any mandatory consumer protection rights, rights to bring claims in a competent consumer forum, rights to contact a regulator, or rights that cannot be waived under applicable law.

For business, trade, hospitality, interior design, procurement, restaurant, villa, hotel, or other commercial-use customers, any dispute that cannot be resolved informally will be handled by the courts of Ontario, Canada, unless Laiya Home agrees otherwise in writing or applicable law requires another forum.

Laiya Home may seek injunctive or equitable relief in any competent court for misuse of intellectual property, fraud, security threats, unauthorized access, or conduct that may cause irreparable harm.

1. Governing Law and Jurisdiction

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein, without prejudice to any mandatory consumer protection rights that may apply in your country, province, state, or region of residence.

For non-consumer and commercial-use disputes, the courts of Ontario, Canada will have jurisdiction unless otherwise required by applicable law.

1. Force Majeure

Laiya Home is not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, extreme weather, war, terrorism, civil unrest, strikes, labour disruptions, supplier failures, transport disruptions, customs delays, pandemics, epidemics, government actions, power outages, internet outages, platform outages, carrier issues, or other force majeure events.

1. Termination

We may suspend or terminate access to the website, customer accounts, services, or orders where permitted by law, including for fraud, misuse, non-payment, security risk, violation of these Terms, legal compliance, or operational reasons.

Sections intended to survive termination will continue to apply, including payment obligations, intellectual property, user content licences, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and any accrued rights or obligations.

1. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, change of control, or transfer of business operations, where permitted by law.

These Terms, together with our Refund Policy, Returns & Right of Withdrawal information, Shipping Policy, Privacy Policy, Cookie Policy, and any other policies or notices posted on our website, form the entire agreement between you and Laiya Home regarding your use of the website and services.

We may update these Terms from time to time. The updated version will be posted on the website with a revised “Last Updated” date. Your continued use of the website after changes are posted means you accept the updated Terms, except where applicable law requires additional notice or consent.
